Service Description and Scope
GameInsights provides professional quantitative research services specializing in player metrics and behavioral analytics for mobile gaming applications. Our services include data analysis, usage statistics, activity tracking, and comprehensive research reports.
We offer various service packages ranging from basic analytics to comprehensive enterprise research solutions, all designed to help gaming companies optimize player engagement and business performance.
Client Responsibilities and Obligations
Clients must provide accurate information about their gaming applications and research requirements. You are responsible for ensuring that any data shared with GameInsights complies with applicable privacy laws and user consent requirements.
Clients must maintain appropriate data collection permissions and inform players about analytics tracking in accordance with relevant privacy regulations and platform policies.
Data Access and Usage Rights
By engaging our services, you grant GameInsights limited access to gaming data necessary for conducting quantitative research. This access is strictly limited to the scope of the agreed research project and is subject to confidentiality obligations.
We will only access and analyze data that is directly relevant to the research objectives and will not use client data for any purposes beyond the agreed scope of work.
Intellectual Property Rights
All research methodologies, analytical tools, and proprietary techniques developed by GameInsights remain our intellectual property. Clients receive rights to use research findings and reports for their internal business purposes.
Client data and gaming applications remain the intellectual property of the client. GameInsights claims no ownership rights over client data or gaming content.
Confidentiality and Non-Disclosure
GameInsights maintains strict confidentiality regarding all client information, research data, and business insights. We will not disclose confidential information to third parties without explicit written consent.
Our confidentiality obligations extend to all employees, contractors, and partners involved in providing research services. These obligations survive the termination of our service agreement.
Service Availability and Performance
While we strive to provide consistent and reliable research services, GameInsights does not guarantee uninterrupted service availability. We may temporarily suspend services for maintenance, updates, or technical issues.
We commit to providing research services with professional diligence and industry-standard methodologies, but cannot guarantee specific outcomes or results from analytics insights.
Payment Terms and Billing
Payment terms are specified in individual service agreements. Generally, payments are due within 30 days of invoice date unless otherwise agreed. Late payments may incur additional charges as specified in the service contract.
All fees are quoted in Brazilian Reais (BRL) unless otherwise specified. Clients are responsible for any applicable taxes, currency conversion fees, or international transfer charges.
Limitation of Liability
GameInsights' liability is limited to the total amount paid for the specific research services that gave rise to the claim. We are not liable for indirect, consequential, or punitive damages arising from the use of our services.
Our liability does not extend to business losses, lost profits, or damages resulting from decisions made based on research insights. Clients are responsible for implementing research recommendations at their own discretion.
Service Termination Conditions
Either party may terminate research services with 30 days written notice. GameInsights reserves the right to immediately terminate services for breach of these terms, non-payment, or violation of applicable laws.
Upon termination, clients will receive all completed research deliverables and we will securely delete or return client data as specified in the service agreement.
Compliance with Gaming Platform Policies
Clients must ensure that their use of our research services complies with all applicable gaming platform policies, including those of app stores and gaming networks. GameInsights is not responsible for platform policy violations.
We recommend that clients review platform-specific analytics and data collection policies before implementing our research recommendations.
International Service Considerations
GameInsights operates from Brazil and provides services to international clients. Clients are responsible for ensuring compliance with their local laws and regulations regarding data analytics and privacy.
These terms are governed by Brazilian law, and any disputes will be resolved in Brazilian courts unless otherwise agreed in writing.
Dispute Resolution Process
We encourage clients to contact us directly to resolve any concerns or disputes. If direct resolution is not possible, disputes will be resolved through binding arbitration in Rio de Janeiro, Brazil.
The arbitration will be conducted in Portuguese or English as agreed by both parties, and the decision will be final and binding on all parties.
Force Majeure and Extraordinary Circumstances
GameInsights is not liable for delays or failures in service delivery due to circumstances beyond our reasonable control, including natural disasters, government actions, or technical infrastructure failures.
In such cases, we will make reasonable efforts to minimize service disruption and communicate with clients about alternative arrangements or timeline adjustments.
Terms Modification and Updates
GameInsights reserves the right to modify these Terms of Service with reasonable notice to clients. Material changes will be communicated via email or prominent website notices at least 30 days before taking effect.
Continued use of our services after term modifications constitutes acceptance of the updated terms. Clients who do not agree to modifications may terminate services as specified in the termination clause.
